Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aviator Nexus platform and its connected applications (including Pylott, ClubPlanes, and other applications we may offer) (collectively, the "Services"), operated by Looking for Traffic, LLC, an Ohio limited liability company doing business as Aviator Nexus ("Looking for Traffic," "we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or otherwise using the Services, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Services

Aviator Nexus is an ecosystem of aviation-related applications that share a common pilot profile. Through a single account, users may access one or more connected applications — which may include tools for certificate and currency tracking, pilot-to-pilot communication, aircraft and maintenance management, and other aviation services. The specific set of applications and features available may expand or change over time. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Not share your login credentials with third parties

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Transmit false, misleading, or fraudulent aviation data
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to gain unauthorized access to any system or network
• Upload malicious code, viruses, or harmful content
• Impersonate any person or entity

5. Aviation Data Disclaimer

Information provided through the Services is for informational purposes only and is not a substitute for official FAA records, certified flight instruction, or professional aviation guidance. You are solely responsible for verifying the accuracy of all aviation data and for complying with all applicable aviation regulations.

6. Intellectual Property

The Aviator Nexus name, the names of its connected applications, the logos, and all associated content, features, and functionality are the exclusive property of Looking for Traffic, LLC and its licensors. You may not copy, modify, distribute, or create derivative works without our express written consent.

7. User Content

You retain ownership of data and content you submit to the Services. By submitting content, you grant us a limited, non-exclusive license to use, store, and process that content solely to provide the Services to you. We will not sell your data or use it for advertising purposes.

8. Subscriptions and Payment

The Services are currently offered free of charge. If we introduce paid features or subscriptions, additional terms — including pricing, billing, automatic renewal, and cancellation terms — will be presented to you at the time of purchase. Any automatically renewing subscription will be clearly disclosed and will require your affirmative consent in accordance with applicable law, and those additional terms will form part of these Terms.

9. Termination

We may suspend or terminate your access to the Services at our discretion if you breach these Terms or engage in conduct that we believe is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Looking for Traffic, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages. In no event shall our total aggregate liability arising out of or relating to these Terms or the Services exceed the greater of (a) the total amounts you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Looking for Traffic, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content or data you submit to the Services.

13. Changes to Terms

We may revise these Terms from time to time. Continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. We will provide reasonable notice of material changes.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, and you consent to personal jurisdiction and venue in those courts.
